General Terms and Conditions (GTC) – Sauna am Fluss

1. Scope of Application and Contractual Partners

These General Terms and Conditions ("GTC") apply to the purchase and use of admission tickets, subscriptions, vouchers, extensions, additional offers and other services of Sauna am Fluss.

By booking online, purchasing admission on site or entering the facility, guests accept these GTC as well as the house rules in force at any time under https://www.saunaamfluss.ch/hausregeln.

2. Offer and Admission

Sauna am Fluss is a public social sauna. Admission entitles the user to utilize the offered infrastructure during the booked time slot or the time slot communicated during the purchase on site.

In principle, admission is valid for two hours. Subject to capacity and operations, an extension of 30 minutes can be purchased for an additional fee. There is no entitlement to an extension or re-entry.

Haus am Fluss AG may deny entry or expel guests from the premises, in particular for reasons of safety, hygiene, capacity, age or behavior. In such cases, there is no entitlement to a refund, provided that the event is attributable to the person concerned.

3. Booking, Conclusion of Contract and Prices

Online bookings are made via the booking platform provided by Haus am Fluss AG. The contract is concluded with the booking confirmation. For walk-ins, the contract is concluded with the purchase of admission on site.

The prices in Swiss francs including VAT currently displayed at the time of booking completion or purchase on site apply. The prices displayed on the booking platform, on the website or on site are decisive.

For discounts, valid, personal proof must be presented upon entry. If this cannot be provided, the difference to the standard rate must be paid immediately. Otherwise, entry may be refused.

Haus am Fluss AG may adjust prices, opening hours, available entry slots, capacities and the range of services at any time for future bookings.

4. Payment

Online bookings must be paid in advance using the payment methods offered. Walk-ins must be paid cashless directly on site.

If payment is unsuccessful, there is no entitlement to entry. Haus am Fluss AG may cancel bookings or refuse entry if there is a justified suspicion of misuse, fraud or unauthorized use.

5. Cancellation, Rebooking and No-show

Free cancellation or rebooking is possible up to 48 hours before the booked entry time via the digital booking platform.

After this period, as well as in the event of late arrival, non-attendance or early departure from the facility, there is no entitlement to a refund, rebooking or credit. Goodwill gestures are made solely at the discretion of Haus am Fluss AG.

If Haus am Fluss AG cancels a booked entry, guests will receive, at the option of Haus am Fluss AG, either a full refund or an equivalent alternative date or voucher. Any further claims, in particular for compensation of travel, accommodation, meals or other consequential costs, are excluded to the extent permitted by law.

6. Subscriptions

The currently available subscriptions, their prices, period of validity and usage limits are clearly indicated on the booking platform or upon purchase. During their respective period of validity, they entitle the holder to entry to the Sauna am Fluss, subject to available capacity and applicable booking rules.

Subscriptions are personal, non-transferable and cannot be combined with other discounts, unless expressly communicated otherwise. They do not renew automatically. Unused entries expire at the end of the validity period. Cash payment, refund or transfer is excluded.

Haus am Fluss AG may block or terminate a subscription if there is a justified suspicion of abusive, commercial or non-personal use. In this case, there is no entitlement to a refund.

7. Vouchers and Discount Codes

Vouchers can be used for services specified by Haus am Fluss AG and are valid for five years from the date of issue, unless otherwise specified on the voucher. Any remaining balance will be retained until the expiry of validity.

Vouchers, discount codes, promotions and partner offers are neither payable in cash nor applicable retroactively. They are only valid under the conditions communicated in each case and may be blocked or declared invalid in the event of abuse.

8. House Rules and Behavior

The current house rules are an integral part of these GTC and can be viewed at https://www.saunaamfluss.ch/hausregeln. Guests must follow the instructions of the staff at all times.

In particular, the following principles apply:

• Swimwear must be worn in the facility.

• Shower before using the sauna and cold plunge pool.

• A towel must always be used as a base in the sauna.

• The cold plunge pool is used at your own risk.

• Glass containers, food brought in and street shoes are not allowed in the sauna area.

• Photo and video recordings in the saunas are prohibited.

• Consideration of other guests, quietness and respectful treatment are required at all times.

• The maximum duration of stay must be observed; re-entry is not permitted.

Minors may only enter the facility if accompanied by and under the responsibility of an adult legal guardian. Haus am Fluss AG may set further age restrictions for individual offers or times.

9. Health and Personal Responsibility

The use of the sauna, cold plunge pool, participation in events and other infrastructure is at your own risk. Guests are obliged to realistically assess their state of health and to refrain from use in the event of discomfort, circulatory problems, acute illnesses, injuries, pregnancy complications or medically recommended restrictions, or to seek medical advice beforehand.

Alcohol, drugs or other substances that could impair safe use must not be consumed in a manner that endangers other guests or operations. Persons who are visibly unable to participate safely may be excluded from entry without refund.

10. Liability

Haus am Fluss AG is only liable for damage caused intentionally or through gross negligence. To the extent permitted by law, any further liability is excluded.

In particular, Haus am Fluss AG is not liable for:

• health consequences resulting from the use of the sauna, cold plunge pool or other facilities, unless these are based on intentional or grossly negligent behavior of Haus am Fluss AG;

• damage resulting from non-compliance with these GTC, the house rules, instructions of the staff or one's own physical limits;

• loss, theft, damage or mix-up of clothing, valuables or other personal items;

• interruptions, limitations or modifications of operations due to weather, high water, official orders, safety reasons, technical malfunctions, force majeure or events beyond its control;

• indirect damage, consequential damage, lost profits or futile expenses.

The lockers provided must be used for personal items and valuables. Use is at your own risk.

11. Operational Changes and Force Majeure

Haus am Fluss AG may temporarily restrict or discontinue the use of individual areas, opening hours, capacities, offers or the entire operation if this is necessary for reasons of safety, hygiene, weather, high water, maintenance, repair, authorities or other operational reasons.

Insofar as an already booked admission cannot be provided as a result, Section 5 shall apply. Further claims are excluded to the extent permitted by law.

12. Data Protection

The processing of personal data is governed by the privacy policy of Sauna am Fluss under https://www.saunaamfluss.ch/datenschutz.

13. Amendments to the GTC

Haus am Fluss AG may amend these GTC at any time. The version in force at the time the contract is concluded shall be decisive. For services already purchased and confirmed, the conditions in force at the time the contract was concluded shall remain applicable, subject to compelling operational or legal reasons.

14. Applicable Law and Jurisdiction

Swiss law applies exclusively.

To the extent permitted by law, the place of jurisdiction is Zurich. Mandatory legal places of jurisdiction remain reserved.

15. Severability Clause

Should any provision of these GTC be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provision, the legally permissible regulation that comes closest to the economic purpose of the original provision shall apply.
